Terms of service

1. Who we are

StarkGen is operated by [Your full legal name or company name], [registered address], Ireland[, company number / CRO number]. Contact: hello@starkgen.app. In these terms "we" means StarkGen and "you" means the person or business using the service.

2. What StarkGen does

StarkGen turns a photo you upload into a short AI-generated video, based on the filters you choose. Videos are made by an AI model and can differ from your photo in small or large ways.

3. Your account

• You must be at least 18 to use StarkGen.
• You sign in with Google or with a link sent to your email. Keep access to that account secure; you're responsible for what happens under your account.
• StarkGen is mainly intended for businesses and creators promoting their own gym, studio or brand.

4. Credits and payment

• You buy credits in packs with a one-off payment. There is no subscription and nothing renews automatically.
• Current prices: 100 credits for €4.99, 500 credits for €14.99, 1000 credits for €24.99. Prices include VAT where it applies.
• A 5-second video uses 10 credits and a 10-second video uses 20 credits. Credits are taken when you start a video.
• If a video fails to generate, its credits are returned to your balance automatically.
• Credits don't expire while your account is open. They have no cash value and can't be transferred to another account.
• Payments are processed by Stripe. We never see or store your full card details.
• Refunds and your right of withdrawal are explained in the refund policy.

5. Photos you upload

Only upload photos that you own or have permission to use. You must not upload photos that:

• show identifiable people who haven't agreed to appear in an AI-generated video;
• show children;
• are sexual, violent, hateful, illegal, or infringe someone else's rights, trademarks or privacy;
• are meant to deceive people, impersonate someone, or make false claims about a real person or business.

We may refuse, stop or delete jobs, and suspend accounts, that break these rules. Credits used for content that breaks these rules aren't refunded.

6. Who owns the videos

You keep all rights in your photos. You may use the videos you generate for any lawful purpose, including paid advertising, social media and your website. We don't claim ownership of your videos.

You give us permission to store and process your photos and videos only to run the service for you, for example to generate, store and show your videos. We don't use your photos or videos to train AI models and don't publish them without your permission.

7. AI-generated content

• AI can invent details, change equipment or produce strange results. Check every video before you publish it. You're responsible for how you use it.
• Videos are AI-generated. Label them as AI-generated where the law or a platform requires it, and never present them as real footage of events that didn't happen.

8. Availability

We aim to keep StarkGen running smoothly but can't promise it will always be available or error-free. Generation times vary with demand.

9. Liability

Nothing in these terms limits rights you have by law as a consumer, or our liability where the law doesn't allow it to be limited. Otherwise, our total liability to you is limited to the amount you paid us in the 12 months before the claim, and we aren't liable for indirect losses such as lost profits or lost business.

10. Closing your account

You can ask us to close your account at any time by emailing us. We may close accounts that break these terms. If we close your account without a good reason, we'll refund any unused credits.

11. Changes

We may update these terms. If a change is significant, we'll tell you by email or on the site before it applies. Credits you already bought keep the price you paid.

12. Law

These terms are governed by the laws of Ireland. If you're a consumer, you can also bring a claim in the courts of the EU country where you live.
